The contract is therefore between an unlawful act and a fiduciary fault. Contracts create a special relationship between the parties, based on fault-independent liability, far-sighted obligations that go beyond the tortious due diligence obligations that persons also owe to foreigners. But at the same time, the special relationship that the contract establishes retains an extremely thin character. The parties remain under market conditions and do not assume any duty of loyalty or any other consideration of indefinite duration. Some transactions are considered illegal and are not enforced by the courts under any law or public order. In theory, English law strives to uphold a principle that people should only be bound if they have given their informed and genuine consent to a treaty. While many agreements can be certain, it is by no means certain that people in the field of social and home affairs want their agreements to be legally binding.
